Aim of the training program

The program of Bachelor’s in Business Law aims to provide fundamental legal and economic knowledge and systematical legal thinking; to provide in-depth knowledge on regulations of domestic and international commercial environment. It also provides professional competence to students for their career or for higher education.

The standard output of the training program

Knowledge and professional competence

1. Understand and apply in practice the system of scientific knowledge of basic Principles of Marxism-Leninism, ideological, moral, and cultural values of Ho Chi Minh, fundamentals of the Revolutionary Policies of Vietnam Communist Party; shape the worldview and methodology for students when approaching and analyzing modern issues of State and Law;

2. Apply the fundamental knowledge of social science and natural sciences to solve theoretical and practical issues related to the training program;

3. Apply the basic knowledge in the field of theoretical and historical issues of State and Law, Constitutional law, Administrative law as well the basic knowledge of Economics in solving theoretical and practical issues related to the training program;

4. Apply the basic knowledge of legal science in the branches of law such as civil law, marriage and family law, criminal law, commercial law, public international law, private international law, etc. in identifying and solving professional issues in practical works;

5. Understand and apply specialized legal knowledge by sector in the field of business law such as the law on business organization, the law on contracts, labor law, land law, environmental law, finance, banking, insurance law, competition law, etc. to solve specific legal issues that arise in commercial activities;

6. Acquire systematic legal thinking to identify and to solve complex legal issues in commercial activities;

7. Apply knowledge in practice to initially familiarize with future professions and adapt to changes in work environment.

8. Acquire skills in foreign language at the third level according to the 6-level foreign language competence framework for Vietnam.

20. Acquire competence to complete complex tasks that require theoretical and practical knowledge application of the training program; acquire competence in analyzing, synthesizing, evaluating data and information, and synthesizing collective opinions;

22. Be capable of summarizing professional practical experience on the basis of knowledge already equipped;

- Group 4: Work for non-governmental organizations, intergovernmental organizations, and international organizations;

- Group 5: Work as researcher and lecturer in business law at institutes, research centers, universities, colleges, and vocational schools.

Teaching, learning, and evaluation strategy

On the training methods

- Lecturers combine the use of modern teaching methods, in accordance with the credit training method and CDIO approach to help students achieve the standard output of the module and the general standard output of the training program;

- Consider students the center of the training process to promote their autonomy. Lecturers must strengthen the role of organization, guidance, orientation and control in learning activities, creative thinking activities and skill training for students in order to actively acquire knowledge and accomplish main targets required by the training program;

- Strengthen active teaching methods to raise self-awareness in learning, self-study capacity; develop creative thinking, practice professional skills, improve teamwork skills, skills of finding, assessing information, presenting and discussing; focus on training self-study methods to create habits, passion and learning ability;

- Promote extracurricular activities, internship programs, and practical experience in the training process to provide practical knowledge for students.

On the learning methods

- Students need to enhance self-study and teamwork;

- Students create their own learning schedule accordingly, and must learn as a desire to explore and have academic passion; learn to understand; learn to self-study; learn to acquire practical skills and practical attitudes in future career; learn to acquire creative, active and independent attitudes in awareness and action;

- Students have to acquire the competence of using modern technology equipment, foreign language, information technology to support their learning.

One the examination and evaluating methods

- Examination and evaluation include: Evaluating students by input results; Evaluating students’ academic progress through a score/chart/learning profile matrix stating students’ abilities and through training programs designed based on outputs; Final evaluation of students’ graduation;

- Lecturers need to use different methods of examination and evaluation in accordance with the module outline for regular assessment, mid-term examination, and evaluation of the end of the module. The scope and indicators of assessment plans must be clear and disseminated to all related subjects. Standards applied in assessment plans must be transparent and consistent throughout the training program;

- Functional units apply appropriate procedures to ensure valid, reliable, and equal examination and evaluating plans.

Guide to the implementation of the program

The training program at the bachelor’s degree in Business Law is applied for candidates who have passed the annual university entrance exam to VNU.

Students entering the program will be introduced to the entire curriculum at the start of the course and will also be instructed to register the selected modules.

On the basis of the approved training program, the Department of Education and Training develop a study schedule for the entire course, including the schedules for each class, each course with the course list of each semester according to the order of the training program. The study plan for each school year is published on the following channels: VNU (for report); the Board of Faculty; Relevant units in VNU; Units of the Faculty; Head Lecturers of classes; Classes of students; Website of the Faculty.

The departments assign lecturers for classes according to the study schedule of the school year and propose exam forms. Dean of the Department decides the form of examination.

After completing all the modules of all knowledge blocks in the training program, students will be awarded a bachelor’s degree in Business Law signed by the President of VNU.

3.2.         Note for modules that belong to the General Knowledge in VNU

- Foreign language modules: (Foreign language 1; Foreign language 2; Foreign language 3) 14 credits: Students can choose to enroll in the module or not according to the schedule of the Faculty, but must participate in the evaluation of proficiency to pass the module and get output standards (B1 level) before graduation.

- Physical Education module: 04 credits, students enroll 01 credit/semester, in the first and second year.

- National Defense Education module: 08 credits, studying for 1 month in the second semester of the first year at Dormitory No. 4 - Hoa Lac.

- Soft skill module: 03 credits, studying according to the schedule of the Human Resource Development Center - VNU.

IV. SUMMARY OF MODULES

1. PHI1004; The Fundamentals of Marxism-Leninism 1: 02 credits

The module provides students with the correct worldview and philosophical methodology through the content of dialectical materialism and historical materialism: Presenting the system of Marxism-Leninism is about nature, society and people, the relationship between nature, society and people; the most general rules of movement, development of nature, society and of human thinking. The theory of Marxism-Leninism on socio-economic form, class, class struggle to liberate people, ethnicity, social revolution, the role of people and leaders in history.

2. PHI1005; The Fundamentals of Marxism-Leninism 2: 03 credits; Code of Prerequisites module: PHI1004

The module provides students with the most basic principles of Marxism-Leninism on the method of capitalist production through studying three economic theories: the theory of value, the theory of value surplus and state monopoly capitalism. These doctrines do not only clarify the main economic laws that govern the movement of a market economy, of capitalist production but also shows the inevitability of the collapse of capitalism and the victory of socialism. On that basis, it clarifies the basic theoretical basis, directly leading to the birth and the main content of Marxist-Leninist doctrine on socialism.

3.  POL1001; Ho Chi Minh’s Ideology: 02 credits; Code of Prerequisites module: PHI1005

The module provides students with the basic understanding of: basis, formation and development of Ho Chi Minh’s Ideology; the system of comprehensive and profound perspectives on a number of fundamental issues of the Vietnamese Revolution, including ethnic issues and national liberation revolution; socialism and the transitional path to socialism in Vietnam; Vietnam Communist Party; great national unity and international solidarity; democracy and building the state of the people, by the people and for the people; ethics, culture and the form of new people; Theoretical and practical contributions of Ho Chi Minh to the Vietnamese Revolution .

4.  HIS1002; The Revolutionary Policies of Vietnam Communist Party: 03 credits; Code of Prerequisite module: POL1001

The module provides students with a basic understanding of Historical circumstances, the foundation of the Vietnam Communist Party - the organization that leads the revolution of Vietnam; Basic and systematic knowledge of the revolutionary policies of the Party, including the system of views, guidelines and policies on the goals, orientations, missión and solutions of Vietnam revolution, expressed through the Party’s platform and resolutions, etc. in the process of revolutionary leadership in Vietnam, from the national democratic people revolution to the socialist revolution, which mainly focuses on the Party’s policies in the renovation period in some basic areas of social life.

The module provides students with a systematic way of basic knowledge of sociology, including objects, functions, the process of formation and development of sociology, concepts, categories and basic sociological principles, research areas of sociology, a number of sociological theories and methods. Based on basic concepts, students can understand the relationships between individuals, communities and society. Social relations are expressed at different social levels and reflect social characteristics of the basic aspects of social life such as economy, politics, culture and society. Society as a whole has a defined structure and can be analyzed according to structural, functional or social action approaches. After completing the general sociology subject, students can generalize the role of individuals, social groups, institutions, social organizations and classes. and social classes in overall society. The module provides learners with the concepts of environmental resources and development; the concept and process of sustainable development in the world and in Vietnam; characteristics, causes and consequences of both environmental degradation and pollution issues, the relationship between the environment and the fields of scientific, technological, economic and social development. Next, the module introduces the legal, economic, scientific and technological tools to protect the environment; programs, areas, goals for sustainable development; some approaches to sustainable development assessment. The module spends a third of the study time for students to study and discuss the relationship between environmental issues and sustainable development in their academic specialties.

The module equips students with a number of basic and simple results of applying statistics to handle two important quantities, very commonly used in practice: ratio and average. That is the parameter estimation problem - the point of hypothesis which is related to the ratio, average, comparing the two average values, comparing the two ratios, checking the independence between the two quantities; the correlation and regression between two variables.

After Adam Smith’s theory, economic doctrines divided into different trends, including two main trends. The knowledge of financial management in the enterprise is one of the important contents in the training program for students in economic universities as well as related industries, including business law. The corporate finance module includes an overview of corporate finance; the rate of exchange of money through time; valuation of stocks; financial analysis and planning; the structure of capital; investment decision; manage working capital.

27. BSA2021; Principles of Business Management: 2 credits

The module provides students with a basic approach to the methods of organizing and operating to improve the business performance of an enterprise in the context of the modern market economy as well as the obstacles that a manager would encounter when conducting business activities, including physical environment, legal economy, politics and internal resources of the industry; planning, organizing, commanding and controlling skills in the areas of human resource management, financial management, production management, market management, accounting and risk management, etc. ; the regional and international business environment and national business opportunities for entrepreneurs. These contents are accessed in a multidimensional and interdisciplinary approach to focus on analyzing and clarifying the key issues of business from many perspectives, since making decisions for hypothetical situations close to reality. At the same time, the module also mentions some practical management skills in corporate governance such as organizational communication, business psychology, economic statistics, etc.

Politics is one of the basic modules in a high-quality law degree training program. This is the module studying the basic contents of political science. The module examines politics as a whole and in relation to institutions and social consciousness forms. The knowledge in this module is the basis for students to study each of the different areas of politics in the world and in Vietnam. This seminal study, in addition to theoretical knowledge, is also linked and discussed typical political events that have happened in the world and country. Therefore, this module not only provides knowledge but also helps shape the capacity for action and political thinking for students.

29. INE2050; Microeconomics: 3 credits

The module provides students with the basic knowledge that is fundamental in forming economic thinking. As part of economics, Microeconomics stems from the scarcity of resources to analyze the market, addressing three basic economic issues: What to produce? How to produce? For whom? Microeconomics focuses on individual behavior - consumers or businesses in each market form and characteristics of corporate behavior and industry in that market. However, the market has its defects, so the microeconomics first mentioned the role of government in the mixed economy.

30. INE2051; Macroeconomics: 3 credits

            The module provides students with basic knowledge of economics - one of the most important foundations that form knowledge and economic thinking. Macroeconomics considers the economy as a whole. It examines the most general issues of the economy. In other words, this science studies large blocks of the economy. These are issues such as production and production growth; jobs and unemployment; price and inflation; international payment balance and rate of exchange; international trade and international monetary system, etc. Macroeconomics not only presents the principles and issues but also focuses on the key macroeconomic policies of the government - impact analysis of these government policies to achieve objectives.

The module equips students with general knowledge of accounting, the role and function of accounting in the economy, the importance of strictly adhering to the general accounting principles. The module will provide students with fundamental knowledge and methodology in accounting practice from handling documents to recording them and making accounting reports (at a simple level). At the same time, this module helps students deal with problems arising in the enterprise from the stage of supply and production to consumption. By being aware of the importance of accounting in enterprises in particular and the economy in general, students can apply their knowledge to the practice of accounting and understand the nature of this work.

32. CIL2002; Civil Law 1: 2 credits

The module provides students with knowledge of Civil Law - an important part of the Vietnamese legal system. Civil law regulates legal status, legal standards for the conduct of individuals, legal persons and other subjects; personal and property rights and obligations in marriage and family relations, business, commerce and labor (hereinafter referred to as civil relations). Civil law has the duty to protect the legitimate rights and interests of individuals, organizations and interests of the State and public interests; to ensure equality and legal safety in civil relations, answer material and immaterial needs of people, and to promote the development of social economy.

The module provides students with the fundamental principles of obligation law - one of the most important and specific areas of private law. The content of the module includes the general theories of obligations, the theory of contract law, law of contractual liability and compensation, and the theory of bases that give rise to other obligations.

The module provides students with basic principles of wealth and inheritance - the most basic and typical areas of private law. The content of the module includes the theory of property law such as property, asset classification, property rights and other rights, ownership forms, etc. and the theory of inheritance law.

35. CIL2004; Marriage and Family Law: 2 credits

The module equips students with knowledge of the Vietnamese Law on Marriage and Family-an important part of the Vietnamese legal system. The Law on Marriage and Family of Vietnam stipulates the legal status and legal standards for the behavior of individuals as subjects of marriage and family relations; personal and property rights and obligations of individuals in marriage and family relations. This branch of law is responsible for protecting the legal rights and interests of individuals in marriage and family relations, especially children.

The module provides basic knowledge of Vietnam’s criminal procedure law including: concepts, objectives, basic principles of criminal procedure law and the development of Vietnam’s Criminal Procedure Law; procedure-conducting agencies, procedure-conducting people and participants in the law; evidence and proof in criminal proceedings; preventive measures applied in the process of resolving criminal cases; prosecution order; investigation, prosecution, trial, criminal judgment execution; cassation review and retrial; procedures for resolving cases where the accused or defendants are minors; procedures for applying compulsory medical treatment; shortened procedures in resolving criminal cases and issues of complaints and denunciations.

The module provides people with basic knowledge about the order and procedures for resolving civil cases to protect legitimate rights and interests of individuals, agencies and organizations in Court. The research subject is the theoretical issues of the Civil Procedure Law and practical implementation in judicial agencies such as: concept and basic principles of the Civil Procedure Law; objectives and powers of civil proceeding authorities and civil proceeding officers, etc.

39. BSL2001; Commercial Law 1: 3 credits

The module equips students with general knowledge of commercial law, components of this legal field and focuses on business subjects, including types of traders. The module helps students to acquire comprehensive understanding of merchants as well as separate legal regulations relating to the establishment, operation, reorganization and termination (dissolution, bankruptcy) of each type of companies. In addition, this module also provides students with legal knowledge regarding Vietnam’s foreign investment activities in relation to foreign laws.

40. BSL2002; Commercial Law 2: 3 credits

The module equips students with important knowledge in Commercial Law – activities of merchants. The Bachelor’s Degree of Law training program in Vietnam divides the trade law module into two parts. The first part takes the law on merchants as the focus. The second part takes the commercial behavior as the focus where students study the general theory of commercial behavior, acts or commercial contracts in accordance with the nature and laws of corporate bankruptcy, cooperation commune, and business and commercial dispute resolution.

41. BSL1010; Finance Law: 3 credits

The module equips students with knowledge about financial resources establishment, financial resources utilization and financial management of the State. The module focuses on studying general theory of public finance, state budget, and Public Finance Law; the role of the State; contents of decentralization of state budget management and the competence of state agencies in managing the state budget fund, creating and using monetary funds in the process of observing the state budget estimates; on management and use of ODA capital, financial management of non-business units, state audit and handling of violations of the State Budget Law. The Public Finance Law is a legal science that studies the general theory of public finance and public finance law, studying specific legal issues related to decentralization of state budget management; on the creation, distribution and use of the State Budget.

42. BSL1006; Banking Law: 3 credits

The module equips students with basic and systematic knowledge about the theoretical issues of the Banking Law, the regulations, creates a basic premise for students to further research on this field, while delivering an overview of the legal status of the Central Bank, of credit institutions, law on banking operations of groups credit institutions, and other organizations with banking activities. These are very important sectors that regulate economic relations in the fields of currency, credit, banking, payment and foreign exchange. In terms of a socialist-oriented market economy, in the context of international economic integration, with the diversity of distribution relations, the circulation of monetary resources in the economy, the role of Banking Law becomes more and more practical.

43. BSL1007; Land Law: 3 credits

The module systematically equips students with basic knowledge of land ownership and management in Vietnam on the specific basis of public land ownership. The Land Law also reflects the theoretical and practical aspects of land users’ rights based on the study of specific legal regimes, thereby covering administrative procedures in land management, land use and procedures for land user to exercise their rights. In addition, the module also provides students with a system of knowledge about land dispute resolution, settlement of complaints and denunciations, laws on housing and types of land that land user could trade the real estate market.

The module equips students systematically with basic knowledge of environmental laws such as: subjects, method of regulations, basic characteristics and principles, main contents of a vast and complex field that is related to all activities in society. These are the contents of environmental impact assessment, principles of sustainable development, principles and measures to prevent and control pollution, degradation and environmental incidents, environmental standards and waste management. In addition, in practice, it initially equips students with some skills to identify, advise and solve problems arising in real life, and the ability to apply theoretical knowledge into reality.

The module provides students with basic knowledge of labor laws such as: regulated subjects, methods of regulation, basic principles of Vietnamese labor law; learning and vocational training; concepts, meanings, contents, forms of labor contracts; invalid labor contracts; sublease labor; some legal issues about wages; time for work and time for rest; occupational safety and hygiene; labor disciplines and material responsibilities; labor disputes and resolution; Strike and solutions for strikes.

46. INL2004; Public International Law: 3 credits

The module equips law students with basic principles and international legal norms which are founded on the agreement and willingness of countries-the principle subject of public international law. This module can be divided into two parts: general issues and specific issues. The former introduces the basic theories of international law such as: basic principles; the doctrines of scholars; subject of international law; foundation and development of international law; and the influence of international law on domestic law. The later deals with specific problems in international relations between countries such as international maritime law; international humanitarian law; diplomatic and consular laws; and international criminal law, etc.

The module equips students with knowledge such as basic reasoning on Private International Law as a legal science subject and a particular legal branch in the domestic legal system; the issue of conflict of laws and the application of foreign laws; principles as well as practical provisions of Vietnamese law on resolution for conflicts in the fields of legal capacity of individuals and legal entities; ownership; contracts; liability for compensation outside the contract; inheritance; marriage and family; labor; principles and substantive provisions of Vietnamese law which directly regulate civil relations involving foreign elements.

            The module provides students with basic knowledge of the foreign exchange market and rate of exchange, international balance of payments, international payment instruments, international payment methods and conditions, international credit and foreign trade accommodation, bank guarantee in foreign trade.

            The module provides students with basic theoretical knowledge of Social Security Law such as regulated subjects, methods of regulation, basic principles of social security law; legal relations of social security; social insurance; health insurance; social incentives; social relief; disputes and mechanisms for settling social security disputes.

50. BSL1009; Law on Immobile Market: 2 credits

The module provides students with basic knowledge of the real estate market in Vietnam, foreign experiences in the real estate market, real estate business activities derived from the principles, types of real estate permitted to be traded, real estate business owners and real estate service business, and transferable projects. Legal knowledge also includes dealing with disputes in real estate, violations in real estate business, and diversified and complex practices.

51. BSL2025; Law on Sale Contracts: 2 credits

The module equips students with legal knowledge related to the formation and execution of sale contracts as well as remedies that may apply when violating contractual obligations. The module consists of 02 credits, divided into 30 periods, with 10 class lectures, 10 discussion sessions based on the situations provided by lecturers, 06 self-study periods and 04 periods for homework and tests.

52. CIL2006; Intellectual Property Law: 2 credits

The module equips students with basic knowledge of intellectual property rights protection: concepts and conditions of protection for objects of intellectual property rights; order and procedures for establishing intellectual property rights, contents and limits of intellectual property rights; intellectual property right holders; identification of infringement of intellectual property rights; protection of intellectual property rights by civil, administrative and criminal measures and control of import and export goods related to intellectual property.

53. BSL2023; Corporate Governance: 2 credits

The module provides students with the issues of owner rights and company management representatives. Students have the chance to familiarize with the principles of modern corporate governance, shareholders’ rights and obligations, equal treatment among shareholders, role of the General Meeting of Shareholders, the Board of members and the Board of directors in companies as well as some problems arising in corporate governance when converting state-owned enterprise to joint stock company. The module is divided into 06 major contents presented and discussed in class and self-study sessions (self-reading and writing curriculum tests).

54. BSL2011; Corporate Finance Law: 2 credits

The module provides students with general issues about capital and assets of the enterprise, management of corporate financial operations; and specific issues such as regulations on charter capital of enterprises; regulations on capital mobilization of enterprises; regulations on corporate financial management. Corporate Finance Law is a legal science that studies the process of creating, distributing and using financial resources in enterprises to help students solve situations arising in corporate financial activities according to the law. The module helps learners gain certain knowledge to evaluate financial activities in enterprises, apply laws to promote the mobilization of financial resources to suit the interests of owners and involved persons in the operation of the business.

55. BSL2024; International Environmental Law: 2 credits

The module provides students with issues of international environmental law such as concepts, meanings and roles of international environmental protection, subject, and regulated objects of international environmental protection, international environment system, international conferences on environment, international environment conventions, international environment institutions, obligations of entities in international environmental protection, experiences of countries in the region and around the world, international environmental standards ISO 14000 and its application in Vietnamese enterprises, identification and handling of international environmental disputes, and especially provisions of the international environmental conventions that Vietnam has signed or acceded to.

56. BSL2010; Securities Market Law: 2 credits

The module equips students with basic theoretical issues about securities, the stock market, clarifies that stock market is one of three types of markets that constitute a financial market, which is essential for students. If in developed countries such as the US, UK, Japan, the stock market and its stock market law are relatively long-established and are important parts of the legal framework in the economy, in Vietnam, the law on securities and securities market is a fairly new legal section, which has not received much attention. This is due to the fact that stock market in Vietnam is a new economic category not only theoretically but also practically.

57. BSL2008; Competition Law: 2 credits

The module provides students with basic knowledge about competition and policies and regulations on competition. The module can help students identify and analyze, assess anti-competitive practices, include anti-competitive agreement, abuse of a dominant position, abuse of monopoly position and economic concentration position; identify and analyze unfair competition practices; understand the regulations on competition management model in Vietnam compared to some countries; understand the regulations on order and procedures for resolving competition cases; understand the legal provisions on handling violations, etc. In addition, the module also helps students to form and develop the ability to collect information, synthesis skills, and systematize problems; skills of comparing, analyzing, commenting, evaluating issues of competition law; initially acquire some skills of market assessment of related products, related goods markets, methods for determining market share and market share combined as a basis for resolving competitive cases and obtaining basic skills in investigation and collection of evidence.

The module provides students with theoretical and practical knowledge of regulations in the field of international trade, including 4 basic content groups: theoretical issues of international trade law; WTO’s fundamental provisions on trade-related goods, services, intellectual property and investment sectors; practical and theoretical legal issues of important international commercial contract transactions, such as international sales contracts, international transport contracts, international insurance contracts, international contracts of transferring technology. The module equips students with basic skills of legal consultancy in two forms, namely verbal counseling and written advice - counseling letters. Previously, legal advice was only taught in Lawyer training institutions. This is a practical activity of legal profession that law students need to do when they desire to become lawyer in their future. Students are truly engaged in reality, have practical experience which have never been acquired from theory lectures. Legal consultancy skills are often divided by the form of advice or divided into legal relations. By form, they are divided into direct written advice and advice by consulting letter; by relation, legal consultancy skills are different in each field of law such as business law, law of contracts, marriage and family law, etc. With this module, students are facilitated to study and learn legal consultancy skills, from receiving consultancy requests to giving legal opinions and legal solutions for customers to protect their legitimate rights and interests.

60. BSL2025; Accounting Finance Consultancy Skills: 2 credits

The module provides students with certain legal skills to handle jobs in financial, accounting and auditing services. Based on the study of main areas of tax, accounting, auditing, this module will focus on analyzing legal advice situations, assessing the shortcomings of multidimensional legal provisions to protect benefits of business, and legal order. The content of this module includes applying legal regulations on determining income subject to corporate income tax, Value Added Tax Law, Import and Export Tax Law, proposing feasible plans and proposing to protect business interests; applying accounting and auditing legal regulations in auditing financial statements to ensure the accuracy of audit results, proposing to improve the internal financial management mechanism.

61. BSL3045; Labor Disputes and Strike Resolution Skill: 2 credits

The module provides basic skills in resolving labor disputes and strikes. In addition, the module also provides students with a specific knowledge system on labor dispute resolution and strikes and some basic skills such as mediation, lawsuits, etc.

62. BSL2030; Credit Contract Dispute Resolution Skill: 2 credits

The module not only provides students with theoretical knowledge about credit contracts such as concepts, characteristics, legal nature, contents of credit contracts, etc., with comparison with foreign laws, but also studies the application of the law on credit contracts and the skills to resolve disputes arising from this contract by various methods such as negotiation, mediation, court, arbitration.

63. BSL2027; Land Dispute Resolution Skill: 2 credits

The module provides in-depth knowledge of land dispute resolution skills in land management in Vietnam on the distinct basis of public land ownership in our country. Land dispute resolution skills are also expressed in terms of theory and practice of land users’ rights based on drafting skills, counseling skills, management skills and litigation skills. Students then have an overview of administrative procedures in management, land use and implementation of land users’ rights. Students can acquire basic knowledge of land dispute resolution. In addition, this module also provides students with a system of knowledge about land dispute resolution, settlement of land complaints and denunciations, laws on housing and types of land that can be traded in real estate market.

64. BSL2028; Law on Evaluation of Environmental Impact: 2 credits

The module provides students with the legal concepts of environmental impact assessment and the basic contents of the concept, meaning and legal nature of strategic environmental assessment (SEA), environmental impact assessment (EIA) and commitment to environmental protection (CEP); procedures to conduct SEA, EIA and CEP, contents of SEA report and EIA report, content of CEP; decentralization of appraisal and evaluation steps of SEA and EIA report.

65. BSL3040; Law on Saving Insurance: 2 credits

The module provides students with basic theoretical knowledge of deposit, characteristics, purpose, role of deposit insurance, regulated subject of deposit insurance, dispute settlement arising from deposit insurance activities, etc. in comparison with foreign law.

VI. EXAMINATION - EVALUATION

Purpose and Characteristics

Lecturers use different assessment techniques of teaching methods to test the knowledge and skill development identified in the objectives of the module, thereby get feedback to help lecturers, students adjust the teaching and learning styles and methods

Lecturers assess the level of achievement of the course objectives at the corresponding period of the students specified in the syllabus.

6.2. Evaluation

Student’s performance is assessed after each semester according to the following criteria:

- The amount of academic knowledge is the total credits of modules (excluding optional modules) that the student enrolled in the semester.

- The amount of cumulative knowledge is the total credits for such modules assessed at the beginning of the training program.

- The semester grade point average is the average point of total credits that students enrolled in that semester (including passed and failed modules).

- The grade point average (GPA) of the module is the average point of total credits for the module that the student enrolled in the training program from the beginning to the time of evaluation (including passed and failed modules).

- The cumulative GPA is the average point of the credits of the modules that student has passed since the beginning of the course until the time of evaluation.

VII. RIGHTS AND OBLIGATIONS OF STUDENT

7.1. Rights

1. To fully enjoy the current regimes and policies of the Vietnam Communist Party and the Government as well as the regulations of Vietnam National University and the training organization;

2. Allowed to leave school for personal circumstances. In this case, students must return the entire training expense from the state budget while studying to the training unit;

3. Students are allowed to leave school temporarily and reserve their study results in the following cases:

a) Mobilized into the armed forces. Temporary absence from school is not counted in the maximum time allowed to study;

b) Suffering from an illness or an accident that requires treatment for a long time with a medical establishment’s certification. Temporary absence from school is not counted in the maximum time allowed to study;

c) For personal reasons. In this case, students must study at least one semester in the training unit, is not expelled school and must achieve a cumulative GPA of no less than 2.00. Temporary absence from school due to personal needs is included in the maximum time allowed to study.

Students who are temporarily absent from school wish to continue their study must submit a written request to the Head of the training unit at least 2 weeks before the expiry of the temporary leave.

7.1. Obligations

1. Perform legal obligations. Foreign learners must obey the Vietnamese law and respect Vietnamese customs and habits;

2. Understand and comply with the regulations and rules of the Vietnam National University, Hanoi and its members;

3. Students must not perform the following acts: using counterfeit diplomas or certificates; cheating in exams, falsify grades; impersonating in exams, internship; not citing referenced documents or paying others to write papers, thesis or dissertations and research projects; performing and participating in illegal activities. Students who are dishonest and commit fraud in scientific research, essays, thesis or dissertations, are subjected to punishments ranging from a one-year suspension to compulsory expulsion.

4. Students who are responsible for complying with the rules of examination will be disciplined if they violate the rules at the following levels:

a) Reprimand: applied to students who look at others’ exam papers, exchange exam papers, discuss in exams. Students who are reprimanded for the examination of a module will be deducted 25% of the points earned on the exam of that module;

b) Caution: applied to students who violate one of the following:

- Has been reprimanded once but continues to violate the regulations in that examination of the module;

- Exchange exam papers or drafts with others;

- Copy others’ exam papers.

Similar exam papers shall be treated equally, unless the student could prove her/his exam papers were being copied by others. The head of the training institution may consider reducing from caution to reprimand. The exam papers of students who are cautioned will be deducted 50% of the points earned on the module examination;

c) Suspension of examination: applied to students who violate one of the followings:

- Have been cautioned once but continues to violate the regulations during the examination;

- After publicizing exam questions, students are found to be carrying unauthorized items;

- Disseminate exam questions or receive answers from outside during the examination.

Suspended students will receive a score of zero (0) in the exam and must leave the examination room immediately after the suspension. The above disciplinary forms shall be recorded in writing by examination officers with evidence and disciplinary forms;

d) Students who impersonate or are impersonated by others in exam will be suspended for one year if they are first time offenders and are expelled if are second time offenders.
